TERMS AND CONDITIONS /
WAIVER OF LIABILITY
These Terms and Conditions (the “Agreement”) govern participation in all retreats, trainings, workshops, or related events (each an “Event”) offered by Ashlyn Bugbee Yoga. By registering for an Event, each participant (“Participant”) acknowledges that they have read, understood, and agree to be bound by this Agreement.

1. Payments
1.1 A non-refundable deposit is required to secure participation in any Event.
1.2 All remaining balances shall be paid in full no later than thirty (30) calendar days prior to commencement of the applicable Event.
1.3 Registrations made within thirty (30) calendar days of the Event start date must be paid in full at the time of booking.

2. Cancellations and Refunds
2.1 Cancellations received more than eight (8) weeks prior to the Event commencement date shall entitle the Participant to a refund of fifty percent (50%) of payments made, less the non-refundable deposit and a twelve percent (12%) cancellation processing fee.
2.2 Cancellations received within eight (8) weeks of the Event commencement date are non-refundable.
2.3 All deposits are strictly non-refundable. Deposits may only be transferred, in whole or in part, to a future Event at the sole discretion of Ashlyn Bugbee Yoga.
2.4 In the event Ashlyn Bugbee Yoga cancels an Event, Participants shall be entitled to apply the amounts paid to any future Event of their choosing, subject to price differentials.
2.5 In the event Ashlyn Bugbee Yoga postpones an Event, Participant registrations shall be automatically applied to the rescheduled date.

3. Transfers
3.1 Participant registrations are non-transferable between attendees.
3.2 Transfers between distinct Events (retreats, trainings, or workshops) are not permitted unless expressly authorized in writing by Ashlyn Bugbee Yoga.

4. Travel Insurance (Mandatory)
4.1 Participants are required to procure comprehensive travel insurance at their own expense, which must include:
(i) trip cancellation for any reason;
(ii) emergency medical coverage abroad; and
(iii) emergency evacuation and repatriation.
4.2 Proof of such insurance shall be provided to Ashlyn Bugbee Yoga prior to departure for any international Event. Failure to provide proof may result in cancellation of participation without refund.

5. Assumption of Risk and Release of Liability
5.1 Participant acknowledges that yoga, meditation, physical activity, excursions, and travel inherently involve risks of injury, illness, property damage, or death.
5.2 Participant affirms that they are in sufficient physical and mental health to safely participate and have disclosed any relevant medical conditions to Ashlyn Bugbee Yoga.
5.3 Participant voluntarily assumes all risks, known or unknown, arising from participation.
5.4 Participant hereby irrevocably waives, releases, and discharges Ashlyn Bugbee Yoga, its officers, directors, contractors, employees, agents, and venues from any and all claims, liabilities, damages, costs, or expenses of any kind, including those arising from negligence, except in cases of gross negligence or willful misconduct.
5.5 Participant further covenants not to sue Ashlyn Bugbee Yoga with respect to any claim released herein, and agrees this release shall bind Participant’s heirs, executors, administrators, successors, and assigns.

6. Medical Authorization
6.1 Participant authorizes Ashlyn Bugbee Yoga and its representatives to obtain emergency medical treatment for Participant should such treatment be deemed necessary.
6.2 Participant agrees to be responsible for, and to indemnify Ashlyn Bugbee Yoga against, any and all costs incurred as a result of such medical treatment.

7. Indemnification
7.1 Participant agrees to indemnify, defend, and hold harmless Ashlyn Bugbee Yoga from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising from Participant’s acts, omissions, or violations of this Agreement.

8. Force Majeure
8.1 Ashlyn Bugbee Yoga shall not be liable for failure to perform or for delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, labor disputes, government restrictions, acts of war, civil disturbances, airline disruptions, or any other force majeure event.
8.2 In such circumstances, Ashlyn Bugbee Yoga may postpone or cancel an Event and shall not be responsible for any costs or losses incurred by Participant outside of amounts paid directly to Ashlyn Bugbee Yoga.

9. Participant Responsibilities
9.1 Participants are solely responsible for obtaining valid passports, visas, required vaccinations, and compliance with local laws and regulations.
9.2 Ashlyn Bugbee Yoga shall not be responsible for denial of entry, travel delays, or additional costs incurred due to Participant’s failure to meet travel requirements.
9.3 Participants acknowledge that Ashlyn Bugbee Yoga makes no warranties or guarantees regarding physical, emotional, or spiritual outcomes of participation.

10. Health and Conduct
10.1 Participant represents and warrants that they have no medical condition that would prevent full and safe participation.
10.2 Respectful conduct is required at all times. Ashlyn Bugbee Yoga maintains a zero-tolerance policy for discrimination, harassment, violence, illegal drug use, or possession of weapons. Violation shall result in immediate expulsion from the Event at Participant’s expense and without refund.
10.3 While Ashlyn Bugbee Yoga endeavors to provide same-sex accommodations where possible, such arrangements cannot be guaranteed.
10.4 Participants must comply with Event schedules, retreat guidelines, and instructions of facilitators.

11. Media Release
11.1 Participant grants to Ashlyn Bugbee Yoga the irrevocable right to use photographic, video, and other media depictions of Participant taken during the Event for promotional, marketing, and related purposes in any and all media.
11.2 Participants who do not wish to be included must notify Ashlyn Bugbee Yoga in writing prior to the commencement of the Event.

12. COVID-19 and Communicable Illness
12.1 In the event of cancellation or postponement due to COVID-19, pandemic resurgence, governmental restrictions, or similar force majeure circumstances, Ashlyn Bugbee Yoga shall provide Participants with the option to: (a) transfer registration to the rescheduled date; (b) transfer registration to a different Event (subject to price differentials); or (c) receive a fifty percent (50%) refund of payments made, less the non-refundable deposit and processing fees.
12.2 Ashlyn Bugbee Yoga shall adhere to applicable governmental and CDC guidelines. Participant acknowledges and assumes all risks associated with potential exposure to communicable illness and agrees to hold Ashlyn Bugbee Yoga harmless therefrom.

13. Governing Law, Jurisdiction, and Attorneys’ Fees
13.1 This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to conflict-of-law principles.
13.2 Any dispute, claim, or controversy arising out of or relating to this Agreement or participation in any Event shall be resolved exclusively in the state or federal courts located in California, and Participant consents to the personal jurisdiction thereof.
13.3 In any action arising under this Agreement, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs.

14. Miscellaneous
14.1 This Agreement constitutes the entire understanding between the parties with respect to participation in the Event and supersedes all prior oral or written agreements.
14.2 If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.3 Failure by Ashlyn Bugbee Yoga to enforce any provision shall not constitute a waiver of such provision.
14.4 Participants must be eighteen (18) years of age or older to register, unless otherwise expressly permitted in writing by Ashlyn Bugbee Yoga with parental or guardian consent.
